Suspect refuses breath test after pickup truck drives over restaurant patio: OPP

Police received two calls about Toyota truck, which they say was observed being driven erratically and doing 'burnouts' at stop signs

A Schomberg resident is facing multiple charges after police received a couple of complaints about a pickup truck Monday night.

The first call came in at around 8:30 p.m. when Ontario Provincial Police were told a Toyota pickup truck heading east on the 5th Line towards Saint James church was driving erratically. 

“The complainant reported being nearly rear ended, stating the truck was conducting burnouts at a stop signs,” said the Nottawasaga OPP detachment in a news release.

Responding officers weren’t able to find the truck, but then at 9:25 p.m., a second call came in.

That caller reported seeing the truck drive over a patio structure at a restaurant in Loretto. The truck was last seen travelling down Tottenham Road and County Road 1.

Soon after, an officer spotted the truck at a Highway 9 Esso station where they say the driver refused a breath test.

The 51-year-old man was charged with: 

  • Failure or refusal to comply with demand
  • Fail to remain
  • Fail to report accident
  • Fail to surrender insurance card
  • Having care or control of a motor vehicle with open container of liquor

In addition to the charges, the driver was issued a 90-day license suspension and the vehicle was impounded for seven days. 

“Failing or refusing to comply with a breath demand whether for an Approved Screening Device or an intoxilyzer at the police station carries the same legal consequences as an impaired driving charge under the Criminal Code of Canada,” OPP added.
