Notice of the Passing of a Zoning By-law

Take notice that the Council of The Corporation of the Town of Bradford West Gwillimbury passed By-law 2024-65 amending Zoning By-law 2010-050 on the 3rd day of September, 2024 under sections 34 and 36 of the Planning Act, R.S.O. 1990, c. P.13, as amended, in respect of lands municipally known as 5648, 5618 and 5584 Highway 9. A key map showing the location of the lands is attached to this notice.

The purpose of By-law 2024-65 is rezone the lands to the Highway Commercial Exception Hold “C3*1(H1)” and “C3*2(H1),” Rural Employment Exception Hold “M3*2 (H1)” and Open Space Exception “OS*6” zones in order to permit both employment and employment-supportive uses within the affected portions of the subject properties. The Holding (“H1”) provision requires specific conditions be satisfied prior to their respective removal. A list of those eligible to make an appeal no later than October 9, 2024, with respect of Council's decision for the passing of the zoning by-law amendment is provided further below in this notice. Appeals can be made to the Ontario Land Tribunal by filing a notice of appeal with Tara Reynolds, Clerk, of The Corporation of the Town of Bradford West Gwillimbury, 100 Dissette Street, P.O. Box 100, Bradford, Ontario, L3Z 2A7. NOTE: Notices may be dropped in the mail slot at 100 Dissette Street, Units 7 and 8, up to the deadline of October 9, 2024. The notice of appeal must set out the reasons for the appeal and must be accompanied by the OLT form (available from the OLT website at https://olt.gov.on.ca) and fee of $1,100.00 payable to the Minister of Finance.

In accordance with Section 34(19) of the Planning Act, any of the following may file a notice of appeal the decision on the zoning by-law by setting out the objection to the by-law and the reasons in support of the objection accompanied with the additional information indicated above with the with the Town clerk:

  • The applicant.
  • A specified person who, before the by-law was passed, made oral submissions at a public meeting or written submissions to the council.
  • A public body that, before the by-law was passed, made oral submissions at a public meeting or written submissions to the council.
  • The registered owner of any land to which the by-law would apply, if, before the by-law was passed, the owner made oral submissions at a public meeting or written submissions to the council.
  • The Minister.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.
