Notice of the Adoption of an Official Plan Amendment, Passing of a Zoning By-law and Granting of Draft Plan Approval to a Subdivision

Take notice that the Council of The Corporation of the Town of Bradford West Gwillimbury passed By-law 2024-67 to adopt Amendment No. 3 to the Official Plan for the Town of Bradford West Gwillimbury, and Zoning By-law 2024-68 on the 6th of August, 2024 and granted Draft Plan Approval under sections 17, 34 and 51 of the Planning Act, R.S.O. 1990, c. P.13, as amended, in respect of lands municipally known as 53, 39, 31 and 23 Danube Lane and 735 and 743 Simcoe Road. A key map showing the location of the lands is attached to this notice.

The purpose of Official Plan Amendment No. 3 is to re-designate 0.07 hectares of the subject lands located to the southeast of the property from “Environment Protection” to “Low Density Residential” to allow for a residential development.

The purpose of the Zoning By-law Amendment is to re-zone the lands from the Future Development “FD” Zone and Environmental Protection “EP” Zone to the Residential One Exception seventeen Hold “R1-2*17(H1)" Zone, Residential One Exception five Hold “R1-4*5(H1)” Zone, Residential Two Exception seventeen Hold "R2-2*17(H1)" Zone, Residential Two Exception eighteen Hold “R2-2*18(H1)” Zone, Residential Two Exception nineteen Hold “R2-2*19(H1)” Zone, and Residential Two Exception twenty Hold “R2-2*20(H1)” in order to facilitate the development of total of ninety-three (93) residential units consisting of twenty-four (24) single detached residential dwellings, eight (8) semi-detached residential dwellings and sixty-one (61) townhouse residential dwellings.

The Draft Plan of Subdivision would divide the subject lands to a total of number (No.) of 17 blocks and 28 lots which would accommodate a total of twenty-four (24) single detached residential dwellings, eight (8) semi-detached residential dwellings and sixty-one (61) townhouse residential dwellings and a 0.2 hectares open space block. Other Blocks for road widenings, common elements and 0.3 m (1 foot) reserves are included in the Draft Plan. The draft plan of subdivision also includes a loop shaped street identified as “Street 2” which is 373 m in length and 18 metres in width and is proposed to traverse through the site and provide access to the majority of the dwellings through ingress and egress from Danube Lane.

Official Plan Amendment No. 3 will be submitted to the County of Simcoe for approval. Any person or public body will be entitled to receive notice of the County's decision if a written request to be notified (include name and mailing address) of the decision is made to the Director of Planning, Development & Tourism Department, County of Simcoe, Administration Centre, 1110 Highway 26, Midhurst, Ontario, L9X 1N6, telephone 705-726-9300, fax 705-727-4276, or email at [email protected].

The Town of Bradford West Gwillimbury, as the approval authority, may, in its discretion, change the conditions of the approval of the proposed plan of subdivision at any time before the approval of the final plan.

You will be entitled to receive notice of any changes to the conditions of approval of the proposed plan of subdivision if you have made a written request to be notified of the changes to the conditions.

In conformity with section 17(23), 34(18) and 51(38) of the Planning Act, information in respect of the proposed official plan amendment and the decision is available to the public for inspection by contacting the Office of Community Planning at [email protected]. A list of those eligible to make an appeal no later than September 23rd, 2024, with respect of Council's decision for the passing of the zoning by-law amendment and approval of the draft plan of subdivision is provided further below in this notice. Appeals can be made to the Ontario Land Tribunal by filing a notice of appeal with Tara Reynolds, Clerk, of The Corporation of the Town of Bradford West Gwillimbury, 100 Dissette Street, P.O. Box 100, Bradford, Ontario, L3Z 2A7. NOTE: Notices may be dropped in the mail slot at 100 Dissette Street, Units 7 and 8, up to the deadline of September 23rd, 2024. The notice of appeal must set out the reasons for the appeal and must be accompanied by the OLT form (available from the OLT website at https://olt.gov.on.ca) and fee of $1,100.00 payable to the Minister of Finance.

In accordance with Section 34(19) of the Planning Act, any of the following may file a notice of appeal the decision on the zoning by-law by setting out the objection to the by-law and the reasons in support of the objection accompanied with the additional information indicated above with the with the Town clerk:

  • The applicant.
  • A specified person who, before the by-law was passed, made oral submissions at a public meeting or written submissions to the council.
  • A public body that, before the by-law was passed, made oral submissions at a public meeting or written submissions to the council.
  • The registered owner of any land to which the by-law would apply, if, before the by-law was passed, the owner made oral submissions at a public meeting or written submissions to the council.
  • The Minister.

In accordance with Section 51(39) of the Planning Act, any of the following may file an appeal of the decision of Council to grant approval to the draft plan of subdivision or any of the conditions of approval by setting out the reasons for the appeal, and accompanied with the additional information indicated above with the with the Town clerk:

  • The applicant.
  • A public body that, before the approval authority made its decision, made oral submissions at a public meeting or written submissions to the approval authority.
  • A specified person who, before the approval authority made its decision, made oral submissions at a public meeting or written submissions to the approval authority.
  • The Minister.
  • The municipality in which the land is located or the planning board in whose planning area the land is located.

No person or public body shall be added as a party to the hearing of the appeal unless, before the by-law was passed or adopted, the person or public body made oral submissions at a public meeting or written submissions to the council or, in the opinion of the Ontario Land Tribunal, there are reasonable grounds to add the person or public body as a party.

No person or public body shall be added as a party to the hearing of the appeal of the decision of the approval authority, including the lapsing provisions or the conditions, unless the person or public body, before the decision of the approval authority, made oral submissions at a public meeting or written submissions to the council, or made a written request to be notified of changes to the conditions or, in the Ontario Land Tribunal’s opinion, there are reasonable grounds to add the person or public body as a party.
